Consultation Terms & Conditions
By agreeing to a consultation with the Law Offices of Kim D. Johnson PLLC (“KDJ Law”), you accept the following terms and conditions in full:
No Attorney-Client Relationship Formed
By participating in a consultation, you acknowledge that no attorney-client relationship is established between you (the prospective client) and Kim D. Johnson, KDJ Law, or any of its attorneys and agents. The purpose of the consultation is solely to provide information of an informational nature. Statements made by KDJ Law during the consultation do not constitute legal advice. To the extent that the consultation might be considered an attorney-client relationship, you agree to waive any such assertion in order to proceed with the consultation.
Confidentiality of Information
Any information you provide to KDJ Law will be kept private and not disclosed to third parties unless required by other legal representations or law. However, this confidentiality does not create an attorney-client relationship.
Waiver of Conflict of Interest
You understand that you have an absolute right to conflict-free legal representation. By engaging KDJ Law for a consultation, you agree to permanently waive any actual or potential conflicts of interest that may arise from the consultation. For example, if you are the opposing party in an ongoing matter and you engage in a consultation with KDJ Law, this will not disqualify KDJ Law from representing the other party. Furthermore, you agree that you are not seeking a consultation for the sole purpose of disqualifying KDJ Law from representing another party. Any information provided during the consultation cannot be used to disqualify KDJ Law from representing another party. If KDJ Law detects an actual or potential conflict of interest, it reserves the right to cancel the consultation at any time. By participating in the consultation, you waive any right to claim a conflict of interest against KDJ Law in its representation of any other party, including yourself, and you agree not to bring any action to disqualify KDJ Law from representing any party for any reason in the future.
Disclaimer of Guarantees and Estimates
Statements made by KDJ Law during the consultation should not be interpreted as promises or guarantees regarding the outcome of your matter. KDJ Law makes no such promises or guarantees. Any comments about potential outcomes are expressions of opinion only. Fee estimates provided by KDJ Law are not guarantees, and you acknowledge that due to the complexity of litigation matters, KDJ Law cannot guarantee overall fees and costs. Actual fees may vary from the estimates given. You acknowledge the inherent risks involved in court proceedings and recognize that no certain outcome can be predicted; KDJ Law cannot guarantee any specific result.
By agreeing to these terms and conditions, you confirm your understanding and acceptance of the limitations and scope of your consultation with KDJ Law.
Refund Policy
The attorney’s time is valuable. By scheduling a consultation directly with the attorney, you are paying for the attorney to set aside dedicated time to discuss your matter. This commitment means the attorney will not engage in other business activities during this time.
No-Show Policy
If you fail to attend your scheduled consultation, the consultation fee is non-refundable as it compensates the attorney for the time set aside specifically for your discussion.
Rescheduling Policy
If you need to reschedule your consultation, you must contact the attorney at least 24 hours prior to the scheduled time. As a courtesy, the attorney will allow one rescheduling without any additional charge. If you need to reschedule more than once, the attorney may, at their sole discretion, charge an additional consultation fee.
Refunds
All other refunds are at the sole discretion of the attorney. By scheduling a consultation, you acknowledge that the attorney is setting aside valuable time for your matter, and thus the consultation fee is considered earned in full upon booking.
By agreeing to these terms, you understand and accept the conditions under which refunds and rescheduling are managed.
Changes to Terms and Conditions
KDJ Law reserves the right, at our sole discretion, to modify or replace these terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.
